Terms of service

These terms apply to SignageDock, including its editor, its display pages and apps, and its website (together, the "service"). SignageDock is operated by PESYSTEMS LLC, a Michigan limited liability company ("we", "us"). By creating an account or using the service, you agree to these terms on behalf of yourself and the business you sign up for ("you").

1. Your account

• SignageDock is for businesses and organizations. You must be at least 18 and allowed to agree to these terms for your business.
• Give us accurate information, and keep your email address up to date so we can reach you about your account and billing.
• Keep your password private. You're responsible for what happens under your account, including what the users you add do. Tell us right away if you think someone else has access.

2. Subscriptions and billing

• SignageDock is a monthly subscription priced per display license. The current price is shown on our pricing page and when you subscribe. Each license lets one paired screen show your content and includes a storage allowance for your media.
• Your first subscription starts with a free trial. A card is needed to start it, and it's charged when the trial ends unless you cancel before then.
• Subscriptions are billed in advance and renew automatically each month until cancelled. Adding display licenses is charged right away for the rest of the billing period; removing them credits the unused time to your next invoices.
• Payments are processed by Stripe. We don't see or store your full card number.
• Prices don't include taxes. You pay any sales or similar taxes that apply.
• We may change prices. We'll tell you at least 30 days before a change affects your subscription, and you can cancel before it takes effect.
• Cancelling, refunds and failed payments are covered by our cancellation and refund policy, which is part of these terms.

3. Your content

• You keep all rights to the layouts, text, pictures, videos, fonts and other material you put into SignageDock ("your content").
• You give us permission to store, copy, process and show your content only as needed to run the service for you, for example to send it to your screens and to make previews and backups.
• You're responsible for your content and for having the rights to use it, including pictures, videos, music, fonts and logos made by others, and for what your screens show in your premises.
• We don't review your content, but we may remove content or pause screens that break these terms or the law.

4. Acceptable use

Don't use SignageDock to:

• show or store anything illegal, or anything that infringes someone else's rights;
• show content that is fraudulent, threatening, harassing, hateful or sexually explicit;
• upload malware, or try to get into accounts, screens or systems that aren't yours;
• interfere with the service, overload it on purpose, or get around its limits or security;
• resell or rent the service to others without our written agreement.

5. Content from other services

Some widgets show content from other providers, such as YouTube videos, web pages, news feeds and weather. That content comes from those providers and is subject to their terms. We're not responsible for it, and it may change or stop working if the provider changes.

6. Availability and changes

We work to keep SignageDock running and your screens playing, but we can't promise the service will always be available or free of errors. We may need to pause it briefly for maintenance. We may also improve, change or remove features; if a change takes away something important you pay for, we'll tell you in advance.

7. Suspension and ending

• You can cancel at any time, as described in our cancellation and refund policy.
• We may suspend or close an account that breaks these terms, puts the service or other customers at risk, or isn't paid. Where we reasonably can, we'll warn you first and give you a chance to fix the problem.
• When a subscription ends, your screens stop showing your content. We keep your media for 30 days and then delete it. You can ask us to delete your whole account sooner.

8. Disclaimers

Apart from what these terms say, the service is provided "as is" and "as available". To the extent the law allows, we don't make other promises or warranties, including that the service will meet a particular need or be uninterrupted.

9. Limits on liability

To the extent the law allows, neither we nor you will be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the amount you paid us for the service in the 12 months before the claim.

10. Claims about your content

If someone makes a claim against us because of your content or your use of the service in breach of these terms, you'll cover our reasonable costs of dealing with it, including legal fees.

11. Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts serving Oakland County, Michigan.

12. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or in SignageDock at least 30 days before it takes effect. If you keep using the service after that, the new terms apply.
